Hynek focuses mainly on litigation and arbitration, banking and finance (mainly export financing), and corporate and public contracts (especially in regards to intellectual property). He is the Leader of the Intellectual Property practice at PETERKA & PARTNERS, focusing mainly on litigations in this area. His wide experience across multiple areas of law and business sectors over the course of his twenty years of practice throughout Central and Eastern Europe enables him to hand both domestic and cross-border transactional and litigation matters efficiently.Hynek has been with the firm since its establishment and became a Partner in 2001. He regularly advises market leaders from a broad range of business sectors, including a dozen of Fortune 500 and CAC 40 corporations, as well as innovative midsized companies.
In his litigation and arbitration practice, Hynek focuses on commercial litigation and arbitration of all types. He represents clients operating in a wide range of sectors, such as banking, energy and infrastructure, construction, machinery, automotive, air and road transportation, pharmaceuticals and life sciences, professional services, and luxury and retail. He has acted as a counsel in arbitrations under the rules of the International Chamber of Commerce, Vienna International Arbitration Centre and the Arbitration Court attached to the Arbitration Court attached to the Czech Chamber of Commerce and the Agricultural Chamber of the Czech Republic.
In banking and finance matters, Hynek has advised and represented several Czech banks, including UniCredit in a number of cases of defaulting export loans in Russia, Ukraine, Belarus, and Slovakia, as well as in purely domestic affairs, including litigations, arbitrations, insolvencies, debt restructurings and legal due diligences related to export financing. He has advised Škoda Auto, the largest Czech car producer regarding its relationships with assemblers of Skoda cars from semi-knocked-down kits in Ukraine and Kazakhstan and dealers in these territories, financing banks and an export insurance company, and has assisted RCI Banque with the establishment and running of a factoring scheme used for the financing of car dealers within the distribution networks of Renault, Dacia and Nissan in the Czech Republic and Slovakia.
In the area of public contracts and utilities, Hynek has advised companies from Veolia Group with respect to several public concessions concerning the operation and maintenance of public water supply and sewerage networks and has worked on such matters in the Czech Republic, Romania and Poland; in addition, he has represented a Veolia subsidiary in litigations and an arbitration related to a complex dispute over the validity of an asset deal and a lease of water infrastructure in a Czech regional capitals.
In the area of intellectual property, Hynek advises and represents clients on all aspects of intellectual property creation, protection, exploitation, and the enforcement of clients’ intellectual property rights and defence against third parties’ intellectual property-based claims, and focuses especially on intellectual property related litigations. Among others, he has represented a Czech subsidiary of Mapa Spontex, a member of Newell Brands group, in a patent litigation before Czech courts and the Czech Patent Office, coordinated with parallel proceedings in several European countries, and Krka, a Slovenian producer of pharmaceuticals, in a litigation before Czech courts over a utility design protecting the composition of a pharmaceutical product.
